1. Agreement to Terms

By accessing or using eras (“the Platform”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Platform. We reserve the right to modify these terms at any time without prior notice. Your continued use of the Platform constitutes acceptance of any modifications.

1.1 Zero Tolerance for Objectionable Content and Abusive Behavior

eras has zero tolerance for objectionable content and abusive users. By using the Platform, you acknowledge and agree that:

  • You will not post, transmit, or share any content that is hateful, harassing, threatening, sexually explicit, violent, defamatory, deceptive, or otherwise objectionable.
  • You will not engage in abusive, threatening, harassing, or predatory behavior toward any other user.
  • We will remove offending content within 24 hours of a verified report, and terminate the accounts of users who provide such content.
  • Every post, comment, moment, and message is subject to user reporting and moderator review.
  • Users may flag objectionable content and block abusive users at any time. Blocking immediately removes the offender’s content from your feed and notifies our moderation team.
  • Repeated violations result in permanent account termination and forfeiture of any associated balances.

2. Eligibility & Age Verification

You must be at least 18 years old to use eras. By using the Platform, you represent and warrant that you are of legal age and have the legal capacity to enter into this agreement. We reserve the right to request proof of age at any time and to suspend or terminate accounts that do not meet this requirement.

Age Misrepresentation: If you misrepresent your age to access the Platform:

  • Your account will be immediately and permanently terminated upon discovery
  • All digital collectibles and wallet balances may be forfeited
  • Any pending payouts or distributions will be cancelled
  • You may be permanently banned from creating future accounts

Parental Concerns: If you are a parent or guardian who believes your child has created an account on eras, please contact us immediately at support@eras.gg. We will investigate all reported underage accounts and, upon verification, we will terminate the account and may issue refunds for any purchases made, at our discretion.

3. Account Registration

To access certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts at our sole discretion, without notice or liability, for any reason including but not limited to violation of these terms.

4. Digital Collectibles

eras enables creators to sell digital collectibles (“Cards”) organized into seasons (“eras”). By purchasing Cards, you acknowledge and agree that:

  • Cards are digital items with no inherent monetary value outside the Platform
  • Card rarity is determined by our proprietary algorithm and is final
  • We make no guarantees regarding the future value, utility, or tradability of Cards
  • All sales are final and non-refundable except as required by applicable law
  • Cards may be subject to availability limits and distribution mechanisms we determine

5. Payments and Fees

All payments are processed through our third-party payment provider (Stripe). By making a purchase, you agree that:

  • All prices are displayed in credits unless otherwise stated
  • You are responsible for any applicable taxes, fees, or charges
  • We may change prices at any time without notice
  • Subscription fees are billed in advance and are non-refundable
  • Platform fees on secondary sales are non-negotiable

6. Creator Terms

If you create and sell content on eras, you additionally agree that:

  • You own or have all necessary rights to the content you upload
  • You grant eras a perpetual, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with the Platform
  • You are solely responsible for the content you create and any claims arising from it
  • We may remove content at our sole discretion without notice or compensation
  • Revenue splits and royalty rates are determined by us and may change
  • Payouts are subject to our verification and compliance procedures

7. Loyalty Rewards Program

eras operates a tiered loyalty rewards program (the "Loyalty Rewards") for Card holders, modeled on airline-miles and retailer-points programs. Rewards credits are issued at our discretion based on your collecting activity and platform activity, and are redeemable only as closed-loop platform credits (not convertible to cash by non-creator holders). Tier status (Platinum, Gold, Silver, Bronze) acts as a loyalty-tier benefit structure, similar to elite airline status. We reserve the right to adjust rewards rates, tier weightings, and program terms at any time. We make no guarantee of any specific rewards amount or rate. Loyalty Rewards are not investment returns, dividends, yields, or interest. Past distributions are not indicative of future distributions. Program participation may be modified or discontinued at any time.

8. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any laws
  • Attempt to manipulate, exploit, or circumvent Platform mechanisms
  • Create multiple accounts, use bots, or engage in automated activity
  • Upload malicious code, spam, or harmful content
  • Harass, abuse, or harm other users
  • Infringe on intellectual property rights of others
  • Attempt to reverse engineer or access Platform systems
  • Engage in market manipulation, wash trading, or fraudulent activity

9. Intellectual Property

The Platform, including its design, features, code, and branding, is owned by eras and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our explicit written permission. User-generated content remains the property of respective creators, subject to the license granted to eras.

10. Copyright & DMCA Policy

We respect intellectual property rights and expect users to do the same. If you believe content on eras infringes your copyright, you may submit a DMCA takedown notice containing:

  • Identification of the copyrighted work claimed to be infringed
  • Identification of the infringing material and its location on the Platform
  • Your contact information (name, address, email, phone)
  • A statement that you have a good faith belief the use is not authorized
  • A statement, under penalty of perjury, that your notice is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

Send DMCA notices to support@eras.gg. We will respond to valid notices and may remove or disable access to infringing content. Repeat infringers may have their accounts terminated.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERAS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED CREDITS, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless eras and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your content.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration authority in our jurisdiction. You waive any right to participate in class actions or class-wide arbitration. The arbitrator's decision shall be final and binding.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles. You consent to the exclusive jurisdiction of the state and federal courts located in Wyoming for the resolution of any disputes.

16. Termination

We may suspend or terminate your access to the Platform at any time, for any reason, without notice or liability. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, disclaimers, indemnification, and limitations of liability.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.
